Judge Dennis Freeman rejected her argument on Tuesday. For HOV purposes, a person is someone who occupies a separate and distinct space in a vehicle, he said.


It's amazing how many different twists the question "is a fetus a person?" can take.

At first when I read that story, I thought the woman was in labour, and thought the police officer was an asshole. Then I read more closely, and I'm disgusted with the woman for trying that.

Since the fetus was sitting in the driver's seat, the cop should have allowed the car-pool excuse and charged the fetus with driving without a license.

In BC, for the purposes of an accident report form, MV6020, a fetus qualifies as a passenger at 18 weeks. I don't know if that would work for Lower Mainland HOV lanes, though.
