Sharon could stand trial in Belgium

quote:
BRUSSELS - The Belgian Senate ratified two key amendments early Friday aiming to keep alive a ten-year-old war crimes law under which international leaders can be indicted. Under the new amendments, Prime Minister Ariel Sharon could stand trial in a Belgian court after he retires from Israeli politics.

Based on this article, it seems that Sharon should indeed be made to stand trial.

Mugabe? For war crimes? Arafat? For war crimes? What the case against them? I'm familiar with the evidence against Bush and Sharon, Hussein too, but you can't just call someone a war criminal because he is a dictator or a terrorist or whatever else you want to label your villain. War crimes are pretty specific. That's why I'm not too clear on the inclusion of Castro in that list of potential belgian defendants. What are Castro's supposed war crimes?

Crimes against humanity, is that what you mean? A different category.

I don't see why they specifically needed the amendment for the indictment to stand up internationally. Was there a challenge to the process in Belgium itself?

Cliquez ici.

quote:
There are two specific types of jurisdiction in international law—prescriptive and enforcement jurisdiction.

The first type of jurisdiction is prescriptive jurisdiction, or “the right to apply its domestic law to individuals.”

If ever there were Belgians killed by Sharon, Mugabe, Arafat, etc, then:

quote:
6. Passive personality principle: this principle can be used to apply one’s laws to individuals who harm one’s citizens abroad. In this case, if a Russian murders a Pole in Russia, the Polish government would have prescriptive jurisdiction to apply their laws to the Russian because their citizen was the victim in the crime. This principle is only slowly gaining acceptance in international law.

Or else...

quote:
7. Universality principle: this principle can be used to apply one’s laws to individuals who commit such horrible crimes that any state may apply their laws to them. This is particularly applicable to our simulation. A few crimes—piracy, slave trade, attacks on aircraft, genocide, war crimes, and most recently terrorism—are considered so heinous that states prohibit them wherever, and against whomever, they occur
